The site is a 1606 sqm, brownfield site on the edge of the settlement, adjacent to a residential area. The previous, now redundant, use was as a waste transfer station. Proposals for a builder’s yard or car mechanic’s yard are both sui generis and as such planning permission would be required for change of use to either of these proposed uses.

The subjects are located at the junction of Leitchland Road and Spey Avenue in the Foxbar area of Paisley. The site is located at the edge of the greenbelt, adjacent to a predominantly residential area.

The Renfrewshire Local Plan (2006) is the current adopted local plan which will require to be considered in the determination of an application for this site. The site is identified as green belt under Policy GB1. The proposed development of this site as a builder’s yard or mechanic’s yard is not compatible with policy GB1. However given the site would result in the redevelopment of brownfield land, the new use will reintroducing the previously established industrial use.
Any proposal for this site would also need to be consider against the criteria set out in Panel GB1 Green Belt Development Criteria, in particular:
(b) traffic and access requirements;
(c) pollution risk; and
(h) appropriate landscaping proposals;
Proposals would also need to be considered against Panel IB1. Business and Industry: General Development Criteria. For this site, consideration would need to be given to:
- The management of noise and limiting disturbance;
- Appropriate screening; and
- Provision for the mitigation of any unacceptable negative impacts.
The development would facilitate the reuse of vacant and/or derelict land and therefore redevelopment of this site would be supported.
The Renfrewshire Proposed Local Development Plan (2013) is not yet adopted but it represents the most up to date settled view of the council and therefore is a material consideration in the determination of planning applications. In the Proposed Plan, the site has also been identified in as greenbelt under Policy ENV1, given that it was an established use in the green belt. Under Policy ENV1 development proposals must accord with criteria as set out in the New Development Supplementary Guidance (SG). It should also be noted that the policy states:
“Support will be given to developments that are able to demonstrate diversification within the green belt and rural areas which promote new employment opportunities and/or community benefits.”
With this in mind new employment generating uses such as a builder’s yard or mechanic’s yard could be supported. Provided there is no significant adverse impact on the character of the green belt.
