The subjects of sale are located in Broxburn, a town situated towards the east of West Lothian with a local population of 9,169. Broxburn lies approximately ten km north east of Livingston and approximately thirteen km west of Bathgate, which are the County’s two largest settlement areas. Broxburn is in close proximity to Junction 1 of the M9, and Junction 3 of the M8 motorway provides convenient access to Edinburgh, Glasgow, the north and the amenities of the central belt.
Within Broxburn, the subjects are situated on the south side of West Main Street just over 2km west of the established town centre. The immediate area is residential and agricultural land and to the south of the site there has been a recent rise in quality residential development.

Potential
The site is within the Broxburn settlement boundary as allocated in the Adopted West Lothian Local Plan (April 2009) (WLLP).
The attached planning brief dated March 2008 and the subsequent update dated October 2013 provide the relevant details and requirements for the development of the site. Prospective developers must take note of these guidelines and are advised to discuss any proposals fully with the Council’s Development Planning and Development Management Units prior to submitting an offer.
All proposals will be considered in relation to the relevant National and West Lothian Council policies and supplementary guidance. Please note that due to the period of time since the planning brief was prepared the developer contributions may vary from those outlined in the planning brief.
Drainage
Developers must comply with SEPA’s Best Management practices and include surface water treatment systems as part of the proposed development. Under no circumstances will the Council accept the implementation of SEPA requirements as being an abnormal or deductible cost. Interested parties are advised to take cognisance of this prior to submitting an offer.

conclusion of the legal agreement.

Terms
Conditions of Sale
· The sites are available individually or separately. When offering for both sites there must be a separate price allocation for each site.
· The sites are available for residential development as outlined in the planning brief and for no other uses
· The proposed development must be consistent with the finalised planning brief for the site (see attached) please note that developer contributions may vary from those stated in the brief.
· The property will be sold as possessed by West Lothian Council and subject to all conditions and/or restrictions affecting it, whether or not contained in the Title Deeds. Any conveyance by the Council shall contain such reservations, burdens and conditions, as the Council’s solicitor may consider necessary for the protection of its interests.
· Offers conditional upon the granting of planning and other consents will be considered, but preference will be given to unconditional offers, other factors such as price being equal. In the case of offers conditional on the grant of planning consent, the planning application for development of the site would require to be submitted within one month of the date of conclusion of missives.
· A planning application for the development of the site or sites will required to be submitted within three months of the date of conclusion of the missives.
· Each party will bear their own legal and other purchase costs and all stamp duty land tax
The Council reserves the right to charge VAT on the purchase price if applicable.

Submitting an offer
- All offers must be in writing in an A4 Envelope clearly labelled “Offer for Holmes Road, Broxburn development site”. The offerer must write his/her name on the back of the envelope. No offers submitted by email or fax will be accepted. All offers are to be sent to the address listed above.
- No offers will be accepted or taken into consideration after the closing date
- The Council does not bind itself to accept the highest or any other offer. However, West Lothian Council have a legal obligation to receive the best price reasonable obtainable.
- Prospective purchasers should also submit with any offer, information sufficient to allow the Council to obtain a suitable financial reference. Where an offer is submitted by a company (which is not a limited or public limited company) or a partnership, directors or partners involved must be named.
- Offers should include detailed development proposals.
Any offers that do not comply with the above instructions will be declared void.

The Council’s Executive will consider and report on the offers and no confirmation of the outcome to offers will be sent to the offerers until after the Executive meeting.
